Terms of Use

These Terms of Use (“Terms”) govern your use of Beyond the Play, operated by Panfinity and Beyond.

By downloading, accessing, creating an account for, or using Beyond the Play, you agree to these Terms.

If you do not agree to these Terms, do not use the application.

1. About Beyond the Play

Beyond the Play is a sports-themed seek-and-find game featuring hidden-object challenges, trivia, levels, sports worlds, collectibles, virtual currency, boosts, progression systems, teams, competitions, and other gameplay features.

Features may be added, modified, removed, balanced, or expanded over time.

2. Player Accounts

Certain features may require a player account.

You are responsible for maintaining the security of your account and for activity occurring through it.

You agree to provide accurate information when required and not to impersonate another person or intentionally misrepresent your identity.

You may not sell, transfer, rent, or otherwise provide your account to another person except where expressly permitted by Panfinity and Beyond.

3. Acceptable Use

You agree not to:

• Harass, threaten, abuse, bully, or intimidate other players.
• Use hateful, discriminatory, sexually explicit, threatening, or otherwise inappropriate player-facing content.
• Impersonate another person or organization.
• Spam other players or misuse community features.
• Attempt to cheat, manipulate scores, exploit bugs, or improperly influence competitions.
• Circumvent game restrictions or security mechanisms.
• Use unauthorized software, automation, modified clients, scripts, or other methods to obtain an unfair advantage.
• Attempt to access another player's account.
• Interfere with the operation or security of Beyond the Play.
• Use the service for unlawful purposes.

4. Teams and Community Guidelines

Players may create or join teams and participate in team competitions.

Team names and other player-facing content must be appropriate for the Beyond the Play community.

Content involving harassment, hate or abuse, threats, inappropriate material, impersonation, spam, or other prohibited behavior may be reported.

Panfinity and Beyond may investigate reports and take appropriate action, including removing content, restricting features, suspending accounts, or terminating accounts when warranted.

Players may also have tools allowing them to block other players.

Submitting intentionally false or abusive reports may itself violate these Terms.

5. Fair Play and Competitions

Beyond the Play may include team competitions, standings, challenges, rankings, rewards, and similar competitive features.

Players must participate fairly.

Attempts to manipulate competition results, exploit scoring systems, repeatedly submit invalid activity, tamper with the application, or otherwise obtain an unauthorized competitive advantage are prohibited.

Panfinity and Beyond may correct invalid results, remove improperly obtained rewards, or take other reasonable action necessary to protect competitive integrity.

6. Virtual Currency and Virtual Items

Beyond the Play may include virtual coins, boosts, XP, collectibles, rewards, or other virtual items.

Virtual items:

• Exist only within Beyond the Play.
• Have no real-world monetary value.
• Are not legal currency.
• Cannot be exchanged for cash through Panfinity and Beyond.
• May be subject to gameplay rules and balancing changes.

Purchasing virtual currency does not give you ownership of any part of Beyond the Play or its underlying software.

7. In-App Purchases

Beyond the Play may offer optional in-app purchases.

Purchases made through the iOS application are processed through Apple's App Store and are also subject to Apple's applicable terms and purchase policies.

Refund requests for purchases processed by Apple may be subject to Apple's refund policies and procedures.

8. Game Changes and Availability

Beyond the Play is intended to evolve over time.

We may add, modify, rebalance, replace, or discontinue levels, rewards, challenges, boosts, virtual items, competitions, features, or other game content.

We do not guarantee that every feature will remain permanently available or that the service will operate without interruptions.

Where practical, we will attempt to avoid unnecessarily disrupting player progress.

9. Intellectual Property

Beyond the Play, including its software, original artwork, game design, graphics, interfaces, level designs, text, logos, branding, and other original content, is owned by or licensed to Panfinity and Beyond and is protected by applicable intellectual-property laws.

These Terms provide you with a limited, personal, non-exclusive, non-transferable, revocable right to use Beyond the Play for its intended purpose.

They do not transfer ownership of Beyond the Play or its content to you.

10. Suspension and Termination

We may restrict, suspend, or terminate access to Beyond the Play when reasonably necessary because of:

• Serious or repeated violations of these Terms.
• Cheating or exploitation.
• Harassment or abusive conduct.
• Fraudulent activity.
• Security threats.
• Illegal activity.
• Conduct that materially harms other players or the service.

Where appropriate, we may use less restrictive measures before terminating an account.

11. Disclaimers

Beyond the Play is provided on an “as available” basis to the extent permitted by applicable law.

We do not guarantee uninterrupted availability, error-free operation, permanent availability of particular game content, or that every software defect will be immediately corrected.

Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Panfinity and Beyond will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use Beyond the Play.

Any limitations in these Terms apply only to the extent permitted by applicable law. Nothing in these Terms limits liability that cannot legally be limited.

13. Privacy

Your use of Beyond the Play is also subject to the Beyond the Play Privacy Policy , which explains how information is collected, used, retained, and protected.

14. Changes to These Terms

We may update these Terms as Beyond the Play changes or as legal or operational requirements evolve.

The “Last Updated” date will identify the latest version. If changes are material, we may provide additional notice when appropriate.

Continued use of Beyond the Play after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

15. Governing Law

These Terms are governed by the laws of the State of Nebraska, without regard to its conflict-of-law principles, except to the extent otherwise required by applicable law.
