Nickel & Know

Nickel & Know is a personal budgeting and financial-organization application designed to help users organize financial information, track spending, manage bills and income, connect supported financial accounts, and access budgeting insights.

Features available to you may depend on your subscription tier.

Not Financial Advice

Nickel & Know is provided for informational, organizational, and budgeting purposes.

Information, forecasts, estimates, suggestions, categorizations, spending observations, and other content generated or displayed by Nickel & Know should not be treated as professional advice or as a recommendation to enter into any financial transaction.

You are responsible for your own financial decisions.

Consider consulting an appropriately qualified professional regarding decisions specific to your circumstances.

Financial Information May Be Delayed or Inaccurate

Financial information displayed by Nickel & Know may be delayed, incomplete, duplicated, incorrectly categorized, unavailable, or otherwise differ from information maintained by your financial institution.

This includes balances, transactions, pending transactions, recurring transactions, bills, income information, and forecasts.

Before making an important payment, transfer, purchase, withdrawal, or other financial decision, verify current information directly with the applicable financial institution.

Your Account

Certain features require a Nickel & Know account.

You agree to provide accurate information when required and to take reasonable steps to protect access to your account and devices.

You are responsible for activity occurring through your account except to the extent prohibited by applicable law.

Contact us promptly at support@panfinityandbeyond.com if you believe your account or information has been accessed without authorization.

Connected Financial Accounts

Paid features may allow you to connect supported financial accounts using Plaid.

By connecting an account, you authorize the processing of financial information necessary to provide the features you request, subject to the permissions associated with that connection.

Availability, accuracy, and refresh timing depend partly on Plaid, your financial institution, and other systems outside PANfinity and Beyond LLC's control.

A financial institution may delay, restrict, interrupt, or discontinue data access.

We do not guarantee that a particular financial institution, account type, transaction, balance, or data field will always be supported or continuously available.

Free, Premium, and Premium+

Nickel & Know may offer multiple service levels, including Free, Premium, and Premium+.

Features may differ between tiers.

Premium may include features such as supported connected-bank functionality, automatic balance and transaction updates, and other connected financial features.

Premium+ may include additional functionality such as user-initiated Refresh Now access and other enhanced features.

We may modify the features included in a tier over time, provided that we honor applicable obligations for subscription services already purchased and comply with applicable law and App Store requirements.

Auto-Renewable Subscriptions

Premium and Premium+ may be offered as auto-renewable subscriptions through Apple's App Store.

Before purchase, Nickel & Know and Apple's purchase interface will display the applicable subscription product, duration, and price.

Subscriptions automatically renew unless canceled in accordance with Apple's subscription-management procedures.

Payment is charged through your Apple Account according to Apple's applicable terms.

Renewal pricing, taxes, currency, billing timing, and other transaction details are determined or displayed through Apple's commerce system.

Apple's subscription purchase confirmation controls the actual amount charged.

Apple requires auto-renewable subscription purchase flows to clearly disclose the subscription name and duration, services provided, full renewal price, and a way to restore purchases.

Managing or Canceling a Subscription

You can manage or cancel an App Store subscription through your Apple Account subscription settings.

Cancellation generally prevents future renewal but does not necessarily terminate access immediately. Access may continue through the end of the period already paid for, subject to Apple's policies.

Apple recommends that apps clearly inform users of this distinction and provide subscription-management assistance during account deletion.

Upgrades and Changes to Subscription Level

Where supported, you may select another subscription option through Nickel & Know or Apple's subscription-management interface.

The timing and billing treatment of upgrades, downgrades, and other subscription changes are determined by Apple's App Store subscription rules.

Only one subscription in a particular subscription group may generally be active at a time.

Refunds

Purchases made through Apple's App Store are processed by Apple.

Refund requests for App Store purchases are subject to Apple's applicable policies and procedures.

PANfinity and Beyond LLC does not independently control Apple's approval or denial of App Store refund requests.

Account Deletion

Nickel & Know provides a mechanism to initiate deletion of your account.

Deleting an account is intended to permanently remove the Nickel & Know account and associated information that PANfinity and Beyond LLC is not required or otherwise permitted by law to retain.

Account deletion may be irreversible.

Before confirming deletion, you should consider whether you need any information stored in your account.

If you have an active Apple subscription, deleting your Nickel & Know account does not cancel that subscription. You are responsible for managing or canceling the subscription through Apple.

Acceptable Use

You agree not to misuse Nickel & Know.

You may not intentionally:

• Attempt to gain unauthorized access to another person's account or data
• Circumvent access controls, subscription restrictions, or usage limits
• Interfere with the operation or security of the App or services
• Use automated methods to overload, scrape, attack, or disrupt the service
• Reverse engineer or attempt to extract protected server-side systems except where applicable law expressly permits it
• Use Nickel & Know for unlawful, fraudulent, or abusive activity
• Introduce malicious code or attempt to compromise our systems

We may restrict access where reasonably necessary to protect users, our systems, or third-party services.

Intellectual Property

Nickel & Know, PANfinity and Beyond branding, application design, software, graphics, text, and other materials provided by PANfinity and Beyond LLC are owned by or licensed to PANfinity and Beyond LLC and are protected by applicable intellectual-property laws.

These Terms grant you a limited, personal, nonexclusive, nontransferable, revocable right to use Nickel & Know for its intended purposes.

They do not transfer ownership of Nickel & Know or its intellectual property to you.

Third-Party Services

Nickel & Know may rely on or interact with third-party products and services, including financial-data providers, financial institutions, Apple services, authentication providers, and cloud infrastructure.

We do not control all aspects of those third-party services and cannot guarantee their continuous availability or accuracy.

Your use of third-party services may also be subject to their respective terms and privacy policies.

Availability and Changes

We work to keep Nickel & Know available and reliable, but we do not guarantee uninterrupted or error-free operation.

Features may temporarily become unavailable because of maintenance, service interruptions, financial-institution availability, third-party outages, security measures, or circumstances beyond our reasonable control.

We may modify, improve, replace, or discontinue features as Nickel & Know evolves, subject to applicable law and obligations relating to paid subscriptions.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, Nickel & Know is provided on an “as is” and “as available” basis.

PANfinity and Beyond LLC does not warrant that the App will always be uninterrupted, error-free, completely accurate, secure, or suitable for every financial purpose.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

Limitation of Liability

To the maximum extent permitted by applicable law, PANfinity and Beyond LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of Nickel & Know.

This includes, where legally permitted, losses resulting from reliance on delayed or inaccurate financial information, third-party service interruptions, financial-institution data, unauthorized access outside our reasonable control, or decisions made based on information displayed by the App.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless PANfinity and Beyond LLC from claims, losses, liabilities, and expenses arising from your unlawful misuse of Nickel & Know or material violation of these Terms.

This provision does not apply where prohibited by law.

Termination

You may stop using Nickel & Know at any time and may request deletion of your account through the available account-deletion functionality.

We may suspend or terminate access when reasonably necessary because of fraud, abuse, security threats, material violations of these Terms, legal requirements, or risks to other users or our services.

Termination of a Nickel & Know account does not independently cancel an Apple subscription.

Changes to These Terms

We may update these Terms as Nickel & Know evolves.

When changes are made, we will update the Effective Date. Where applicable law requires additional notice or consent, we will provide it.

Your continued use of Nickel & Know after updated Terms become effective constitutes acceptance to the extent permitted by law.

Governing Law

These Terms are governed by the laws applicable to PANfinity and Beyond LLC, without regard to conflict-of-law principles, except where the laws of your jurisdiction require otherwise.

Nothing in these Terms deprives you of mandatory consumer protections available under applicable law.
